Subject: Renting above a shop Posted on: Mon, 7 Jan 2008 20:46:14 +1100

Couple renting apartment above retail shop.
Apartment occupied for 21 years from the same lease.
Retail shop sold dresses from 9-5 for decades.
Then shop changed to Hippy stuff and closed around 6pm for about 7 years.
It is the same owner for upstairs apartment as for downstairs retail shop.

Now the new tenant in the shop is planning to have a hair studio with three
people working until 9pm 6 days a week. (9pm only a couple of nights
but....)
Noise travels easily between apartment and shop so couple in apartment are
worried about noise and hours of operation of the hair studio that is
coming.
Another issue is a shared backyard that the shop will require customers to
have access for toilet use as well which could affect security.
Couple has tried to communication with the new shop tenant numerous times
only to find them hostile and the conversation turn confrontational and
non-productive.
Any suggestions? Couple would still prefer to work WITH shop tenant however
is getting upset with the shop tenant due to renovation work being carried
out until 10:30pm on a couple of nights and a displayed poor attitude to
others and reference to "no clear law" that is interpreted as a green pass
to do what they like.

One further point is member of couple plays music and welcomed the shop
tenant and provided contact details should there ever be trouble with noise.
Shop tenant has used this number a few times. Once was to complain about the
natural volume of a nylon string guitar. Another time was to complain about
the volume of music at 3:30pm pm New Years Eve! Shop tenant also confronts
couple as they are entering or leaving their house though the couple has
only just asked for this to stop and should anything wish to be discussed
call and arrange a time.

The couple are not very happy with how their home environment is changing.
Any suggestions?
