if you are injured by a motor vehicle impact, the CTP provider will pay
(once liability is admitted by the CTP co) for all medical expenses required
to get the injured back to health - medical attention, procedures, rehab,
physio, medications etc. and once the situation is stable, ie the injury
stabilises / heals or goes away and all is good, the CTP insurer will pay
out the injured to settle the case and clear their books after 3 years max.
If the claimant is not happy with the sum offered, a CARS claim is issued to
the insurance company with a counter claim. The insurance co. will then
make another stab somewhere between their initial offer and the counter
claim amount - this is normal.
In this case, the CTP insurer will be liable for all and any medicals for
all injuries to all people. To have the bikes fixed, that is a
comprehensive insurance claim against the driver who refers this to his
comprehensive insurer. They may well tell him he is on his own through any
proven malicious actions by himself.
Time will tell and heal all wounds. Hopefully.
