Very interesting (and all very confusing as well). My wife (U
citizen) just applied for a settlement visa on the basis of marriage t
me (dual UK / US citizen) from the New York consulate and she received
UK Entry Clearance valid for only two years. We have been married fo
19 months but have been living in a "relationship similar to marriage
for 11 years, which was fairly well documented in our application (an
I understand should qualify her for indefinite leave to remain).
Should she have received something different?
What is the correct process for an American spouse of a UK citizen fo
more than four years to obtain Indefinite Leave to Remain? Do you:
(a) apply for entry clearance from the UK Consulate in the US firs
before immigrating, and then for ILR immediately once in the UK,
(b) apply for ILR from the UK Consulate in the US before immigrating,
(c) apply for ILR from the IND in the UK before immigrating, or
(d) something else?
Thanks in advance for any guidance (as the various entities' web site
are vague about this)!
