You will not be in the US legally until you have properly filed form I-
485 (assuming you are eligible to file it). Filing I-130 by itself
doesn't give you any right to stay in the US. Marriage by itself also
does not give you any right to stay in the US. So unless you are
maintaining some other legal status, you are deportable until you file
I-130 *and* I-485.
