My Filipina wife and I wanted to go back to her home for xmas. We
married in the US Nov. 2004. applied for adjustment of status and got
an advance parole for Dec.2005 to Jan.2006. We went to the Philippines
and right before we were to return to the US we had to fight a law
suit in the courts. One case filed against us and we filed a case
against them, all very very time consuming. We are still fighting this
civil case to this day (2 years).
We assume my wife's status has been considered abandoned since we have
not been able to leave the country. What are our options if and when
we settle this law suit and wish to return to the US?
