Okay, I know they're not trick questions. But they're questions where
the correct answers are not immediately apparent to me.
My K-1 import and I are going to marry on May 4th and then we're going
to start all this AOS application business.
I-864:
Should I use my married or maiden name on this form? In fact, would it
make anything any clearer if I waited to change my name, or does that
not affect anything either way?
Part 5: Checkbox for "if you are currently married, your spouse". At
the time this form is filed he will be my spouse. But of course he's
also one and the same as the principal immigrant.
I *think* I should leave this box blank since he's already been
counted once, but that won't seem in some way fraudulent, will it? Or
for that matter cause them to deny his I-485? ("What do you mean you
got married? Right here says she's got no current spouse...")
I-485, Part 3:
Place of last entry. He was examined by an officer in the Toronto
airport, because they have USCIS on the Canadian side there. Is his
place of entry then "Toronto" (seems odd...) or "San Francisco"?
(actually the airport is not in the city limits but I suppose that's
not an issue...)
"In what status". Is this "alien fiance"? (I know that's the status he
entered under, just not sure what language to use since it does not
match one of the examples, e.g. visitor, student...)
I-765:
Q. 15 "Current status" -- We'll be filing this along with the I-485.
Is this also "alien fiance" (or whatever words)? Or is he something
else?
Q. 16 category -- since we're filing this *with* the I-485, is he (a)
(6) (K-1 status) or (c)(9) (has already filed an I-485)? |
