I saw a post saying that there may be someone here that could shed
some light on a situation I have. Currently I am working on a TN Visa
in the US. I got married and filed for my EAD, Advance Parole, and
normal I-485. My EAD has still not arrived and my TN expires soon.
My company's immigration lawyer says that I can apply for an extension
on my TN because that will take about 2 months to be processed and
then it will be denied but in the mean time I can legally work. My
immigration lawyer says I should not go ahead with the extension as it
may cause problems with having duel intent. I should have my new EAD
within the next 30 days.
Has anyone gone through something similar? Or know if my companys
immigration lawyer is correct? Will I be okay to file the extension
papers through an I-129? I do not want to jeoprodize my greencard
application.
Any experience would be very helpful.
