not clear: who was charged with a felony, the mexican or the USC?
What is the 'status' of the mexican? No paperwork at all? or
immigration status pending?

Was he 'convicted' or just charged? If convicted the prospects are
poor in the current immigration climate. You WILL need a lawyer, and
the chances will still be slim.
