It is illegal to enter the country with the intent of staying without
the appropriate visa. A K1 visa is the appropriate type of visa for
someone that intends to get married and then live in the US.
If she enters on a different visa and decides to marry you, then the
two of you should consult with an immigration attorney the marriage has
taken place.
