Insurance companies seem less likely to roll over without a fight where
there are circumstances to suggest they are not liable these days. It seems
that they have decided to fight back in the no-win no-fee litigation
explosion. Mine actually defended a bogus injury claim just over a couple
of years ago. Indeed, they not only defended the claim but managed to avoid
paying for the claimed damage to her car as well. Since my car was
completely unscratched, they even decided not to record it as an accident
(my fault ot otherwise), thus preserving my 12 year unblemished record.
