A friend ( really, I do have one ) of mine works as a district
nurse. She is a smoker. Obviously she has to travel between
patients by car as they are spread over a fairly wide area.

She uses her own car for which she receives a mileage allowance.
Due to the nature of the job it is sometimes necessary for her to
have a colleague travel with her.

Is she breaking the law by smoking in her own car ?

Does receiving a mileage allowance make your own vehicle a
"company car" for journeys covered by the allowance ?
