The judge decides whose evidence he prefers. If you are able to give clear
and confident evidence it is quite likely you will be believed.
You must also remember that most cases don't go to court. If you sue for a
sum of less than, say, 500 pounds, the defendant will probably want to
settle rather than take up money and time defending the claim, unless they
are sure you are a fraud.
