Consider this scenario:
I object to you taking "my" parking space in a supermarket car park.
We have an argument. I put a deep scratch down the side of your car.
You call the police, who arrest me for criminal damage. I tell the
police that I scratched your car but it was an accident - the police
don't believe me and I am charged. The magistrate however agrees with
my defence solicitor that the CPS cannot prove BRD that I scratched
your car intentionally, so declare "no case to answer" and I walk
free.

Would you consider that I am an innocent victim of injustice and you
are the malevolent troublemaker? How about if I was 40 years old and
you were 17 years old?
