I had a delivery of a bed three months ago:

1. when the delivery team looked inside my house they said they would
probably have problems getting the bed upstairs because the gap
between the stairs and the ceiling was narrow. As a consequence, they
said, they may damage the mattress trying to take it upstairs.

2. They asked me to sign an 'Awkward Delivery Disclaimer', the text of
which is below:

"The product that you have chosen seems difficult to deliver into your
particular property/bedroom. The Delivery Team will (at your risk)
endeavour to carefully manoevre the product to your required location
but cannot accept liability for damage to the product or property that
is caused as a result of this awkward delivery. Therefore:
a) Pictures, light fittings, ornaments and other moveable obstacles
should be moved prior to
b) If your order will not fit into your bedroom the delivery team will
leave your purchase in an alternative location at your home
b) The delivery team are not permitted to bring the goods back to the
warehouse
I understand that I am responsible for any damage caused during
delivery: My signature"

3. My wife pointed out the smoke alarm on the ceiling in my hallway
and asked if we should remove it. The delivery team said it would be
fine and not to bother. BTW, this was near to but not in the area that
the delivery team identified as a problem.

4. The delivery team then rushed in with the mattress knocking the
smoke alarm from the ceiling

5. I wrote a note on the delivery form saying, 'Smoke alarm knocked
from ceiling. Delivere warned and we asked if it should be removed.
Delivere said it would be OK'

I've tried to make a claim against Dreams but they say that as I've
signed the disclaimer all they can do is offer me £50 as a good-will
gesture.

Does signing the disclaimer really allow them to damage my home at
will and negate any responsibility?
