Whist that is obviously true, but I think the point was that as the brother
was sharing the house, and was presumably sharing some of the running
expenses, it could be argued that he had a finacial interest in the house,
and that this could form part of the estate. Even if it is not the case, it
could be used as a response to the girlfriend's claims.
