I'm assuming you've had friendly words with him before about the
noise?

If so, I don't see the problem? You've asked him nicely to stop being
anti-social and he's not listened, you didn't really have very many
other alternatives.

Of course, if you've just fired off a letter to the council without
talking to the guy first, he might well be miffed......
