I'm not 100% certain of this, but when this area was covered in one of our
annual "Employment law awareness brief for managers" sessions a few years
ago they said that an employer can insist that an employee works the notice
period. This means that (at the employer's discretion) it can cause
cancellation on any pre-booked leave during the notice period. If the
employer exercises this discretion then any outstanding leave entitlement
would be paid in lieu. Equally the employer can (if they so wish) decline to
pay leave in lieu and insist that the employee "uses or loses" any leave
entitlement before leaving. Quite how this works if the leave entitlement
exceeds the notice period I'm not sure. But then a wise employee would take
this into account when giving notice - the contract may say that the minimum
notice is (say) 14 days, but there's nothing to prevent an employee giving
three or even six months notice if they wish. If there are good relations at
the time (ie the reason for departure is not due to a row) good companies
will actually approciate the longer notice period as it allows more time to
recruit a replacement and/or plan handovers etc.
