In what context would the embassy even care? If you are a US citizen, a
*consulate* (not an embassy, those only deal with governments) should
provide you with a replacement if you can prove your citizenship.

If you are not a US citizen and are outside the USA (there are no US
embassies in the USA, so I assume you are outside the USA), then the US
government really has no interest in whether you have a passport. Of
course, you would need one to apply for a visa - but it is not of much
concern to the consulate whether that is a replacement passport or not.
