Subject: H1B1 Transfer Posted on: Tue, 04 May 2004 17:39:19 +0000

An unique opportunity has befallen on me. Currently I am on my 5th year
into H1b1 with an employer A based in Alaska. Employer B based in
Florida has made me a job offer yesterday. They are willing to petition
for h1b1 transfer, but do not know how to proceed so they have asked me
to guide them through the paperwork. Here are my questions, and plan of
actions I plan to udertake:

1. I am excempt from quota cap, correct?

2. I will ask the employer to file LCA electronically through DOL
website. Will this be acceptable for transfer case? Or should it be done
by through fax or mail?

3. Once LCA is filed, I am technically allowed
to work for company B. Correct?

4. While LCA is being filed, I will
furnish employer B with my current notice of action, i-94, copy of my
visa stamp and passport including recent two paystubs from employer A,
and have them send them along with the approved new notice of action to
INS to service center in Dallas, Texas. Is this sufficient? Do I need to
consider anything else?

5. They expet me to start working starting June
1, 2004.

6. I was thinking about using my immigration attorney locally
in Alaska. Will it be a problem to assign this to Alaska attorney for a
job related to Florida?

I would apprecaite if anyone can answer those
questions. Thanks a lot.

Jak
