The 10 foot pole is entering on a tourist or other visa and deciding to
adjust status a short time later. The issue is whether or not USCIS
believes she committed fraud by entering on a tourist visa when she knew
she was going to stay in the US. (Note: I am not saying she did this,
only that USCIS might think she did). For this reason, I would recommend
an attorney.
