More to the point. It is pefectly legal if he wants to come as a tourist
and get married. However, if he wants to stay, then he can't have intent
to do this when he enters. We actually got married while my wife was on
a tourist visa. Then, he could go back to his home country while waiting
for the visa process.
Then I flew to Moscow to file the I-130 and 40 days later she had the
Visa appointment and got the CR-1 Visa.
Of course, now the US citizen has to be living in Russia in order to do
this, instead of just visiting. I don't know if other consulates allow
consular filing of the I-130 if the US citizen is non resident.
He doens't need to let the intent issue stop him from getting married.
