helo. long story short:came under J1 Jun/05, married Aug/05, filled
docs for 485 Sep/05 (J1 expires Oct/05), got RFE Oct/05, got interview
Sep/06, interviewer did not ask a lot just ask what do you have, I
gave bills, joint tax returns, apartment lease both names, cars both
names, bank account both name, bunch of pictures (but did not ask for
wedding), she only asked how did you meet, I said we talked alot over
internet, she cut me off saying "on the marriage site", I said, no it
was a regular site, she was very nice to us, but still proffessional I
had a feeling she is just doing her job and wants be fair both to us
and a camera that was recording. I flooded her with evidence and I
think it worked out.. she never ask and now I think it is my opinion I
gave her criminal background checks for both names, she said "oh! I
need them!", then she looked that my wife (us-citiziten) is on a
parole (she got into fight with somebody and bigmouth was not nice to
the police officer), she had a year of parol and was in the middle of
it during interview, it looked like for OP it was very important as
she took some notes. then she looked in the computer and said I need
you birth cer, I sad I gave you one she said: no no I need a full
version. you need to get it from your country. that's all for now. I
ask do we know wether approved or not she said without birth cert dont
know anything. Gave us 3 month to send it it took me 2 weekes to get
it sent out, waited another month, scheduled Infopass, OP said yes we
got it we do not need anything more from you come back in 90 days if
we dont get in touch with you.
Now, since then it is already 1,5years that we are still waiting -
nothing. I was there a week ago - "just backgrounds pending, go home
we will let you know". now, I started doing my research and internet
tells me that backgrounds from FBI/CIA usually takes up to 2 weeks,
usually "backgrounds pending" may mean "investigation pending". So
here are my questions:
1) is it possible that we are being screened, like some private
detective looking at us our bills, credit cards, score, etc..?
2) do you know how long does this investigation takes
3) now recently, I had a better offer to work in different city,
around 100 miles away from Orlando (our home and uscis local office
handling our case); I took it renting an apartment that I can be there
on a week basis (I am computer programmer) and coming back home
Orlando for weekends. Our daughter (I am not father, but my wife did
not married before), is in the Orlando school now my wife does not
want to move because of daughter; she got a bunch of friends and is in
that age that we do not want to do it she loves her school and is an
honored student every year. I got 50% raise and was already doing a
lot, I can handle both places easily, while, unfortunately at the
current point my wife does not work at all.
I found this website that says you cannot be denied because you do not
live together (we do partly though).

I am just wondering how much all this situation will affect, and if
the uscis is actually having my docs on holds just to see what future
will bring (so they can denied).
