legal resident trying to reenter the us without a greencard Posted on: Wed, 23 Apr 2008 23:32:30 -0400

Hi,

here is the case, well, basically:

a friend of mine was petitioned and sponsored by his father into the US

In order to enter the states, his passport was stamped with a US visa.

When he entered they officially stamped his foreign passport with a I-33
(?) and this stamp gave him temporary legal status till he gets his green
card, which could take years

He doesn't still have a green card even though he did finish the
application and is just waiting for it to come in the mail

Now, he was home sick and went back to his own country "for a while"

Questions:

1) How long a while could it be if he would like to come back to the
states?

2) Can he reenter just with the initial visa he was granted to enter the
states, without a reentry permit?

Thanks
J
